Plain language, because a board like this does not need six pages of legalese.
Effective 30 August 2026. These terms govern your use of elementbid (the "Service"): the board, the claim flow, checkout, and everything around them. By using the Service or paying for a tile, you agree to these terms and to our Privacy Policy. If you do not agree, do not claim a tile.
Who runs this
elementbid is operated by Jorge (@codebyjorge), an independent developer. Public contact and legal or removal notices: reach out on X.
These terms work alongside the public Rules, which describe the pricing mechanics and are generated from the live code. If the Rules and these terms ever conflict, these terms control.
What the Service is
elementbid is a paid public advertising board. You may pay to place an app you own on one of 118 element tiles. Listings are paid placements. They are not reviews, endorsements, certifications, awards, or any independent assessment of quality.
A payment buys the tile at the price shown when the payment is confirmed, for as long as you hold it. It does not buy traffic, clicks, downloads, customers, revenue, a guaranteed duration, search ranking, or any other outcome. Anyone can pay more and take the tile from you at any time. We may change, pause, or discontinue features of the board.
Eligibility
- You must be at least 18 and able to enter a binding contract.
- If you claim on behalf of a company, you confirm you are authorised to bind it, and "you" includes that company.
- You may not use the Service if sanctions or applicable law prohibit us from providing it to you.
Payments and taxes
Checkout is handled by Polar as merchant of record. We never receive or store your card details; Polar's own terms and privacy notice apply to the payment itself. Prices are in US dollars, and applicable taxes may be added at checkout.
The price is always computed on our servers at the moment of purchase, so the price shown on a tile is the price charged. Completing checkout is an offer to buy that placement. The tile is assigned when Polar confirms the payment and the claim is written to the board.
Refunds
Payments are final. Placement is a digital service that starts the moment the payment is confirmed. Being outbid a minute later, getting fewer clicks than you hoped for, changing your mind about the element you picked, downtime, or a removal for breaking these terms do not create a refund. Being outbid is the mechanic you are paying to take part in, not a defect in it. By completing checkout you are asking us to start that service immediately and, as far as the law allows you to waive it, you give up any cooling off or withdrawal right. Where a consumer right cannot be waived, we honour it.
One narrow exception: you are charged but the tile is never granted to you. That happens only when somebody takes the tile while your payment is still settling. We refuse the claim rather than granting it late, and return the payment in full. This is not a change-of-mind allowance — it exists because you would otherwise have paid for nothing at all. Reviewed and issued by hand, so allow a few business days.
Chargebacks or payment disputes without a legally valid basis are a breach of these terms; we may remove the listing and refuse further use of the Service.
What you may list
Only an app you own or are authorised to represent, via an App Store, Mac App Store, or Google Play link. By submitting a listing you represent and warrant that:
- you have the right to list that app and send visitors to it;
- the listing and its destination comply with applicable law, including advertising, consumer, privacy, and intellectual property rules;
- you are not impersonating another person, brand, or company, and are not claiming a tile for a competitor's product without authorisation;
- the destination is not malware, phishing, a scam, or otherwise designed to deceive; and
- the information you submit is accurate.
Prohibited listings
You may not list or use the Service for:
- sexual or pornographic content, or adult platforms; chat, invite, or messaging-group links; or link shorteners that hide the real destination;
- anything illegal, fraudulent, defamatory, harassing, hateful, violent, or exploitative of children;
- counterfeit goods, unauthorised streaming, or other infringement of copyright, trademark, or other rights;
- offers requiring licences you do not hold, including certain financial, medical, gambling, or weapons-related offers;
- interfering with the Service: manipulating click counts, evading rate limits, automated claiming without our written permission, or scraping beyond ordinary browsing.
Removal
We may refuse, edit, or remove any listing that breaches these terms, without refund. We may also remove a listing whose store link breaks or whose app is delisted. Removals are logged. Removing a listing does not restore any $0 opening claim, so a removed listing cannot be used to re-claim the same tile for $0.
Availability
The Service is provided as-is, with no guarantee of uptime, continued operation, traffic, or results. Click counts are best-effort and de-duplicated per visitor per day; they are an indication, not an audited advertising metric. If we shut the board down we will say so publicly in advance, but we owe no compensation for time remaining on a tile.
Liability
To the maximum extent the law allows, our total liability to you for any claim relating to the Service is limited to the amount you paid us for the tile the claim concerns. We are not liable for indirect or consequential losses, including lost profits or lost business.
Changes
If we change these terms materially, the change applies to claims made after it takes effect. The Rules page is generated from the live pricing code and is always the authoritative description of the mechanics.
